Asaba, located in Delta state – The judgment of the national and state houses of assembly election tribunal in Asaba, which pronounced Ndudi Elumelu the victor of the 2023 election, has been overturned by the Court of Appeal in Abuja.
According to The Nigerian, Elumelu is a federal constituency representative for the Aniocha/Oshimili area in Delta state. He identifies with the People’s Democratic Party (PDP) as his political affiliation.Ngozi Okolie, a candidate for the Labour Party (LP), was found to be the victor of the election by the appellate court, which issued its decisions on Thursday.
It found issue with the tribunal for nullifying Okolie’s election and then proceeded to throw out the petition that Elumelu had submitted to the trial tribunal, which was the basis for the verdict that was nullified.
The Court of Appeal agreed with the lawyer for the Labour Party, Mahmud Magaji (SAN), who argued that contrary to the finding of the tribunal, Okolie was properly nominated and sponsored by his party, and that he resigned his appointment as a Senior Special Assistant (SSA) to the Delta State Government as required by the Constitution. Okolie also resigned his appointment as a Senior Special Assistant (SSA) to the Delta State Government.
