The All Progressives Congress (APC) and Uche Nnaji, its candidate for governor of Enugu State in 2023, appealed the Supreme Court’s decision to reinstate Peter Mbah of the Peoples Democratic Party (PDP) as the election’s victor.
The legal team for the APC and Nnaji reportedly filed an invalid brief of argument and failed to persuade the court with compelling arguments as to why the appellants’ incompetent brief should be permitted. This was according to a five-member panel of the supreme court, presided over by Justice Tijani Abubakar.

According to Abubakar, since the appellants’ brief was deemed to be invalid, the appeal for which the appeal was brought was likewise affected by the invalidity.
